Except where exigent circumstances occur, the maximum number of inmates to be housed at any one time in the Central Detention Facility is capped at 2,164 inmates.
Exigent circumstances, include, but are not limited to, mechanical failures or natural disasters.
Whenever exigent circumstances occur and cause the District to exceed the inmate cap set in § 532.1, the District will provide prompt written notice to plaintiffs' counsel of record in Anderson, et al., v. Fenty, et al., Superior Court of the District of Columbia case number 2005 CA 005030 B, of the circumstances necessitating the temporary suspension of the cap, and the anticipated time the District believes it will be necessary to exceed the cap.
