Rule 28-530 - SEGREGATION PENDING LAW ENFORCEMENT AGENCY INVESTIGATIONS
530.1

When a resident is confined in segregation pending investigation for possible criminal prosecution, the Administrator (or his or her designee) shall maintain contact with the law enforcement agency handling the investigation.

530.2

The resident shall be notified every fifteen (15) days of the agency's report of the progress of the investigation.

530.3

Upon notification by the investigating law enforcement agency that no criminal prosecution will be initiated against the resident, the resident shall be released from segregation unless, within three (3) working days of receipt of that notification, the Board determines, after a housing hearing held in accordance with the provisions of this chapter, that the resident is in danger from a threat to the resident's personal safety, poses a danger to the safety of others, or is a definite escape risk.
