The Contracting Officer shall review information which a person designates as confidential or proprietary and which is submitted in response to an IFB or RFB.
If the Contracting Officer determines that the designation is proper, the information shall be treated by the contracting officer, and any other District employee, in a confidential manner, shall be disclosed only to District employees for use in the procurement process, and shall not be disclosed to other persons or parties without the prior written consent of the person, except as provided by the Freedom of Information Act of 1976, effective March 25, 1977 (D.C. Law 1-96; D.C. Official Code §§ 2-531, et seq.) (2011 Repl.)).
