Rule 27-3704 - SETTLEMENT MEMORANDUM
3704.1

At the conclusion of settlement negotiations, the contracting officer shall prepare a settlement memorandum containing the principal elements of the settlement for inclusion in the contract file.

3704.2

If the settlement was negotiated on the basis of individual items, the contracting officer shall specify the factors considered for each item. If the settlement was negotiated on an overall lump-sum basis, the contracting officer shall not have to evaluate each item or group of items individually, but shall support the total amount of the recommended settlement in reasonable detail.

3704.3

The settlement memorandum shall include explanations of matters involving differences and doubtful questions settled by agreement and the factors considered.
