Rule 27-2709 - CONSENT OF SURETY
2709.1

If a contract is modified, the contracting officer shall obtain the consent of surety in the following circumstances:

(a) When an additional bond is obtained from another surety;
(b) When no additional bond is required and the modification is beyond the scope of the original contract; or
(c) When no additional bond is required and the modification does not change the scope of the contract but increases or decreases the contract price by more than twenty-five percent (25%) or fifty thousand dollars ($50,000).
2709.2

The contracting officer shall obtain the consent of surety for a novation agreement.

2709.3

The contracting officer shall obtain the consent of surety when a contract is to be awarded after the deadline set for contract award unless the written commitment of the surety extends to or beyond the date the contract is signed.
