Rule 26-C406 - FINDINGS
406.1

In those instances where a hearing officer, other than the Commissioner, conducts the public hearing, the hearing officer shall make written findings and recommendations to the Commissioner within fifteen (15) days after the close of the public hearing.

406.2

In those instances where the Commissioner conducts the hearing, the written findings and recommendation regarding the application shall be made within thirty (30) days following the close of the hearing.

406.3

In any event, the findings and recommendation of the Commissioner, together with a copy of the application and any other relevant information or submissions, shall be transmitted to the Council within sixty (60) days (in the case of applications by regional and nonregional bank holding companies considered pursuant to D.C. Official Code § 26-704(c) and 26-706.1, respectively) and within ninety (90) days (in the case of applications for charters considered pursuant to D.C. Official Code § 26-704(a)) after the filing of the application, unless the time period is extended by the Commissioner in accordance with applicable statutory provisions.

Pursuant to D.C. Law 17-59, the Bank Charter Modernization Amendment Act of 2007, effective December 11, 2007, (codified at D.C. Official Code § 26-704) the requirement for the Commissioner to transmit findings and recommendation and any other relevant to the Council, together with a copy of the application, and any other relevant information and submissions to the Council within sixty (60) days, in the case of applications by regional and nonregional bank holding companies considered pursuant to D.C. Official Code §§ 26-704(c) and 26-706.1, and (in the case of applications for charter considered pursuant to D.C. Official Code § 704(a) after the filing of the application) within ninety (90) days after the filing of an application, pursuant to subsection 406.3, was repealed.
