Rule 26-C2729 - TRUSTEE LIABILITY

2729.1

The liability under the Act for a trustee who is defined as a lender shall be limited to Section 539 b of the Act (D.C. Official Code § 42-815.02(e)(2)(A)(iii) ) for the trustee's exercise of a power of sale or the issuance of a Notice of Intention to Foreclose a Residential Mortgage or Notice of Foreclosure Sale of Real Property or Condominium Unit in violation of the Act or this chapter.
