Rule 26-B310 - FAILURE TO APPEAR
310.1

If a party fails to appear at the hearing, either personally or through counsel, the Commissioner may proceed to hold the hearing in that party's absence.

310.2

The Commissioner may also hold the absent party in default and may issue a proposed or final decision and order against the defaulted party.

310.3

A party defaulted as a result of a failure to appear at a hearing may file a written motion, within five days of the service of the order of default, requesting reconsideration by the Commissioner. The motion shall state the grounds for the request, and include a proposed order.
