Rule 25-I305 - ADMINISTRATIVE REMEDIES - NOTICES OF INFRACTIONS (NOIS), FINES AND PENALTIES
305.1

The Department may impose against any property owner civil infraction fines and penalties for violations of any provision of these Regulations pursuant to the Department of Consumer & Regulatory Affairs Civil Infractions Act of 1985 (Civil Infractions Act), effective October 5, 1985 (D.C. Law 6-42; D.C. Official Code §§ 2-1801.01et seq. (2016 Repl.)); and the Preventive Health Services Amendment Act of 1985, as amended, effective November 27, 1985 (D.C. Law 6-83; D.C. Official Code § 7-176 (2018 Repl.)).

305.2

A property owner who receives a Notice of Infraction as specified in Subsection 400.1, may pay the assessed fine or appear before the Office of Administrative Hearings as directed on the reverse side of the Notice of Infraction in accordance with the "Office of Administrative Hearings Rules of Practice and Procedure" in Section 2808, Title 1 of the District of Columbia Municipal Regulation.
