The Department may impose civil infraction fines penalties for violations of any provision of these regulations pursuant to the Department of Consumer & Regulatory Affairs Civil Infractions Act of 1985, (Civil Infraction Act), effective October 5, 1985 (D.C. Law 6-42; D.C. Official Code §§ 2-1801, et seq. (2016 Repl.)).
An operator who receives a Notice of Infraction as specified in Subsections 900.1 and 901.1, may pay the assessed fine or appear before the Office of Administrative Hearings as directed on the reverse side of the Notice of Infraction in accordance with the "Office of Administrative Hearings Rules of Practice and Procedure" in Section 2808, Title 1 DCMR, as amended.
