Rule 25-B3518 - ADMINISTRATIVE - SUMMARY SUSPENSION, WARNING OR HEARING NOT REQUIRED
3518.1

The Department may summarily suspend a license or dealer certification as specified in section 3516 by providing written notice as specified in section 3517 of the summary suspension to the licensee or dealer, without prior warning, notice of a hearing, or prior hearing.

3518.2

The licensee or dealer shall have the right to request a hearing within fifteen (15) business days after receiving the Department's summary suspension notice. The Department shall hold a hearing within seventy-two (72) hours of receipt of a timely request, and shall issue a decision within seventy-two (72) hours after the hearing. The request for a hearing shall not act as a stay of the summary suspension.
