The purpose of the radiation provisions of this title (chapters 67 through 69) is to specify the requirements in the use of all radiation, radiation machines, and radioactive materials to ensure the maximum protection of the public health and the maximum safety to all persons at, or in the vicinity of, the place of use, storage, or disposal of radiation, radiation machines, and radioactive materials.
The radiation provisions of this title are intended to be consistent with the best use of radiation machines and radioactive materials, and to encourage the constructive uses of radiation.
Except as otherwise specifically provided, the radiation provisions of this title shall apply to all persons who receive, possess, use, transfer, own, or acquire any source of radiation; Provided, however, that nothing in these provisions shall apply to any person to the extent such person is subject to regulation by the Nuclear Regulatory Commission (the "NRC").
Nothing in the radiation provisions of this title shall be interpreted as limiting the intentional exposure of patients to radiation for the purpose of diagnosis or therapy.
Regulation of source material, byproduct material, and special nuclear material in quantities not sufficient to form a critical mass is subject to the provisions of any agreement between the District and the NRC, and to part 150 of the NRC's regulation ( 10 C.F.R. Part 150).
Each section of chapters 67 through 69, and every part of each section, is declared independent of every other section, and the finding of any section, or part of a section, to be void or ineffective for any reason shall not be deemed to affect any other section, or part of a section.
