Rule 22-B4200 - SUBMISSION OF APPLICATIONS
4200.1

An applicant shall submit an application for a CON in writing on a form prescribed by SHPDA. The form shall contain the information that SHPDA uniformly prescribes and publishes as requirements for a CON.

4200.2

An application for major medical equipment or a capital expenditure shall specify the applicant's proposed timetable to make that service or equipment available and to complete the project, as well as other information SHPDA shall require for evaluating the application under the appropriate review criteria, the State Health Plan, and the requirements of the District of Columbia Health Services Planning Program Re-Establishment Act of 1996, (D.C. Official Code § 44-401et seq.).

4200.3

SHPDA shall use a single form for each type of application, except transfer of ownership, even though not all questions on the form may be relevant for a particular type of application. SHPDA, in a pre-application meeting between the applicant and an assigned SHPDA staff member, shall specify for each applicant the questions that require responses for that application.

4200.4

If SHPDA determines that an application is incomplete, and that additional information is needed to evaluate the application, SHPDA shall request additional information from the applicant pursuant to the requirements of Subsections 4200.5 through 4200.7.

The information requirements may vary according to the purpose of the review or the type of health service being reviewed.

4200.5

A request from SHPDA for information from the applicant pursuant to § 4200.4 and in connection with a CON review shall be in writing and limited to the information that is necessary for SHPDA and SHCC to perform their reviews.

4200.6

SHPDA shall notify the applicant in writing when it has determined that the application is complete.

4200.7

SHPDA may review an application that has not been determined to be complete if the applicant has declined to provide further information and shall base its findings on the information available from the applicant that will demonstrate that the application complies with the HSP or the applicable criteria and standards for the service or HCF.
