When the primary caregiver believes that an emergency exists which jeopardizes the residential placement temporarily, they may request emergency respite care.
The Administration shall assess each request for emergency respite and make a determination as to whether an emergency exists.
If no emergency exists, the applicant will be referred to the appropriate agency or resource.
When it is determined that an emergency exists, the Administration shall take whatever action is necessary commensurate with the nature of the emergency.
In the event that the nature of the emergency warrants the immediate relocation of the mentally retarded person for purposes of respite, the Administration shall identify an appropriate respite facility and make arrangements to effect the emergency respite placement of the mentally retarded person.
The Administration shall require, to the extent possible, the same information included in § 1601.3 for making informed decisions.
