Rule 20-3620 - LIHEAP - ADMINISTRATIVE APPEALS
3620.1

Each applicant who is aggrieved by an action or inaction of the Department related to receipt of benefits under this program shall be entitled to a fair hearing with the District of Columbia Office of Administrative Hearings (OAH) or its successor in accordance with OAH Rules, 1 DCMR §§ 2800et seq. and Public Benefits Cases Regulations, 1 DCMR §§ 2970et seq.

3620.2

The applicant shall have ninety (90) calendar days following receipt of a notice of eligibility, in whole or in part, to request a fair hearing.

3620.3

Upon receipt of a fair hearing request, the Department shall offer the appellant or his or her authorized representative an opportunity for review of the benefit determination.
