Rule 20-205 - NEW SOURCE PERFORMANCE STANDARDS
205.1

The requirements of 40 C.F.R. part 60, subpart A, as in effect on July 29, 2021, together with the terms used and defined, are hereby adopted by reference for the purpose of implementing the New Source Performance Standards (NSPS) for source categories pursuant to the requirements of Section 111(b) of the Clean Air Act, 42 U.S.C. § 7411(b), except as indicated in § 205.3.

205.2

The following provisions of 40 CFR Part 60, as in effect on July 29, 2021, with the terms used and defined in those provisions, are hereby adopted by reference, except as indicated in § 205.3:

205.3

The following exemptions to the language in 40 C.F.R. part 60 are hereby made:

(a) The word "Administrator" as used in the adopted portions of 40 C.F.R. part 60 shall be taken to mean "Director of the Department of Energy and Environment" except in the following sections, where "Administrator" shall have the meaning specified in 40 C.F.R. § 60.2:
(1)40 C.F.R. § 60.8(b);
(2)40 C.F.R. § 60.11(b);
(3)40 C.F.R. § 60.11(e);
(4)40 C.F.R. § 60.13(a);
(5)40 C.F.R. § 60.13(d)(2);
(6)40 C.F.R. § 60.13(g); and
(7)40 C.F.R. § 60.13(i);
(b) The following sections from 40 C.F.R. part 60 are not adopted:
(1)40 C.F.R. § 60.1(d);
(2)40 C.F.R. § 60.4(b);
(3)40 C.F.R. § 60.9;
(4) That part of 40 C.F.R. § 60.4211(f)(3) that reads: "Except as provided in paragraph (f)(3)(i) of this section, the 50 hours per calendar year for non-emergency situations cannot be used for peak shaving or non-emergency demand response, or to generate income for a facility to an electric grid or otherwise supply power as part of a financial arrangement with another entity."
(5)40 C.F.R. § 60.4211(f)(3)(i);
(6) That part of 40 C.F.R. § 60.4243(d)(3) that reads: "Except as provided in paragraph (d)(3)(i) of this section, the 50 hours per year for non-emergency situations cannot be used for peak shaving or non-emergency demand response, or to generate income for a facility to an electric grid or otherwise supply power as part of a financial arrangement with another entity." and
(7)40 C.F.R. § 60.4243(d)(3)(i).
205.4

A person shall not construct, modify, or operate or cause to be constructed, modified, or operated a New Source Performance Standard (NSPS) source which results or will result in a violation of this section.

205.5

Each individual violation of a requirement of the provisions of 40 C.F.R. part 60 that are adopted by this section shall constitute a separate offense for each day of the violation for the purposes of applying the penalty provisions in 20 DCMR § 105.
