Rule 11-G701 - MISCELLANEOUS
701.1

In the MU-4/RC and MU-5A/RC zones, in addition to other applicable provisions of this title, the requirements of this chapter shall apply to:

(a) All new construction;
(b) All additions, alterations, or repairs that, within any eighteen (18) month period, exceed in cost fifty percent (50%) of the assessed value of the structure as set forth in the records of the Office of Tax and Revenue on the date of the application for a building permit;
(c) Any use that requires a change in the use listed on the owner's or lessee's certificate of occupancy; and
(d) Any existing use that requires a new permit from the Alcoholic Beverage Control Board.
701.2

If there is a dispute between the property owner and the Zoning Administrator about the cost pursuant to Subtitle G § 701.1(b), the cost shall be determined by the average of the estimates furnished by three (3) independent qualified contractors selected in the following manner:

(a) The first shall be selected by the owner;
(b) The second shall be selected by the Zoning Administrator; and
(c) The third shall be selected by the first two (2) contractors.
701.3

The estimates provided for by Subtitle G § 701.2 shall be prepared and submitted according to a standard procedure and format established by the Zoning Administrator.

701.4

The cost of estimates shall be at the expense of the property owner.
