Rule 11-2928 - ASSOCIATED RELIEF
2928.1

Relief from any section of this chapter may be heard and decided by the Commission as a special exception in accordance with § 3104. In addition to the criteria of § 3104, the applicant shall demonstrate that the purposes of the USN District would be met even if the relief were granted.

2928.2

An applicant requesting approval of a project that would result in nonconformity with the minimum residential or maximum non-residential FAR for the USN District, as established by § 2908, shall demonstrate how the proposal would not be inconsistent with the purpose of establishing a mix of uses.

2928.3

The Zoning Commission may hear and decide any additional request for special exception or variance relief from any other provision of the Zoning Regulations for the subject property.

2928.4

Request for relief shall be advertised, heard, and decided together with the application for Zoning Commission review and approval.
