This chapter shall set forth rules governing the operation of the Housing Production Trust Fund (the Fund), and administered by the D.C. Department of Housing and Community Development (DHCD).
The purpose of the Fund shall be to provide financial assistance to non-profit and for-profit developers for the planning and production of low, very low and extremely low income housing and related facilities.
The Fund is established under the authority of the Housing Production Trust Fund Act of 1988, D.C. Law 7-202 (the Act), D.C. Code § 45-3101 et seq. (1990 Repl. Vol.).
The Director, for good cause shown in writing, may waive any provision of this chapter, except the provisions of §§ 4101.3, 4105.2, 4106.1, 4106.4, 4107.11, and 4110.3 consistent with applicable law. All waivers shall be justified by a determination that undue hardship will result from applying the requirement and where application of the requirement would adversely affect the purpose and objectives of the Fund.
