Rule 10-B4099 - DEFINITIONS
4099.1

When used in this chapter, the following words and phrases shall have the meaning ascribed:

Act - the Housing Production Trust Fund Act of 1988, D.C. Law 7-202 (D.C. § 45 -3101 et seq. (1990 Repl. Vol.)).

Alienation - the act of transferring property to another, including the sale or transfer of title or the leasing of use of property.

Applicant - a non-profit organization which submits an application for assistance under the Nehemiah Program, or the entity receiving Nehemiah Program assistance and selling Nehemiah homes.

DHCD - the D.C. Department of Housing and Community Development.

Director - the Director of the D.C. Department of Housing and Community Development.

District - the government of the District of Columbia.

District resident - a resident of the District of Columbia at the time of execution of a contract to purchase a Nehemiah home, including persons who work in, or who have been notified of and have accepted a full time job in, the District of Columbia.

First time homebuyer - a purchaser who has had no ownership interest in their principal residence at any time during the three (3) year period ending on the date of their execution of a contract to purchase a Nehemiah home, but including a purchaser who has divorced or separated during the three (3) year period where a formal settlement has been made under which the applicant does not receive an ownership interest in a primary residence which had been jointly owned.

HPAP - the Home Purchase Assistance Program, as described at 14 DCMR 25.

Low income - a household or family whose annual income is less than fifty percent (50%) of the median family income for the Washington Metropolitan Area, adjusted for family size, as determined by DHCD periodically based on available data.

Moderate income - a household or family whose annual income is at least fifty percent (50%) and no more than eighty percent (80%) of the median family income for the Washington Metropolitan Area, adjusted for family size, as determined by DHCD periodically based on available data.

Nehemiah Program - the Nehemiah Community Housing Opportunity Program authorized by § 4(b) of the Housing Production Trust Fund Act of 1988, D.C. law 7-202 (D.C. Code § 45-3101 et seq. (1990 Repl. Vol.)).

Neighborhood-based - as used in the context of neighborhood-based non-profit organizations, refers to an area served by the organization that has a population of at least two thousand five hundred (2,500) persons and is distinguishable from other areas based on natural or man-made boundaries, a locally recognized name or other distinctive characteristics.

Non-profit organization - a private non-profit corporation or other legal entity which qualified as a tax exempt organization under § 501(c)(3) of the Internal Revenue Code of 1986, approved October 22, 1986 (68A Stat. 3; 26 U.S.C. §501(c)(3) ).

Single family home - a single dwelling unit which has an identifiable, self-contained property interest (which may be sold by one person to another) located in a structure; may include dwelling units in a condominium or cooperative project.
