Rule 1-2202 - SERVICE OF PAPERS, METHODS, PROOF
2202.1

A party shall serve upon all other parties any submission made to the Board.

2202.2

Any paper required to be served upon a party shall be served upon him or her, or upon the representative designated by him or her or by the law to receive service papers. When a party has appeared by attorney, service may be made upon the attorney of record.

2202.3

Service may be made by personal delivery, by first class mail, or as otherwise authorized by law. When there are numerous parties to a proceeding, the Board may make special provisions regarding the service of papers.

2202.4

Service upon a party is complete if one of the following actions is taken:

(a) By personal delivery, on handling the paper to the person, or leaving it at his or her office with his or her clerk or other person in charge or, if there is no one in charge, leaving it in a conspicuous place therein or, if the office is closed or the person to be served has no office, leaving it at his or her usual place of residence with some person of suitable age and discretion then residing therein;
(b) By mail, on deposit in the United States mail, properly stamped and addressed; or
(c) By conformity with an order of the Board.
2202.5

Proof of service, stating the name and address of the person on whom served and the manner and date of service, shall be shown for each document filed, and may be made in one of the following ways:

(a) Written acknowledgment by the party served or his or her counsel;
(b) The certificate of counsel, if he or she has made the service; or
(c) The certificate of the person making the service.
