Section 101-C-1.0 - Introduction
1.1 The original Regulations Governing Delaware's Coastal Zone (Regulations) were promulgated in 1999 to implement the 1971 Coastal Zone Act (CZA). This guidance was developed to support the application of those regulations. The Coastal Zone Conversion Permit Act (CZCPA) of 2017 required the Department to revise the Regulations, which was done with the recommendations of a Regulatory Advisory Committee (RAC) that deliberated from September 2018 through April 2019. This guidance document was also revised to reflect changes in the authorizing legislation and the revised regulations.
1.2 This guidance is not a regulation and does not have the force of law. In the event of a conflict between this guidance and the regulations, the regulations will prevail.
