Section 7102-59.0 - Area of review59.1 The area of review for each injection well shall be determined according to this Section. The Department may solicit input from other technical professionals to determine which method is most appropriate for each geographic area. The area of review may be determined by fixed radius only after the GWDS has calculated or approved the radius to be used.59.2 Zone of endangering influence: The zone of endangering influence shall be determined in accordance with a submitted methodology that has been reviewed and approved by the GWDS, and 40 CFR Part 146 § 146.6 (a)(1) and § 146.6 (a)(2).59.3 Fixed radius. 59.3.1 In the case of application(s) for an individual injection well permit(s), a fixed radius around the well of not less than one-fourth (1/4) mile may be used.59.3.2 In determining the fixed radius, the following factors shall be taken into consideration: Chemistry of injected and formation fluids; hydrogeology; population and ground-water use and dependence; and historical practices in the area.59.4 If the area of review is determined by a mathematical model pursuant to subsection 59.2, the permissible radius is the result of such calculation even if it is less than one-fourth (1/4) mile.59.5 The GWDS may require that a radius of influence be calculated. The radius of influence may be determined based on aquifer characteristics, screen length (if applicable), depth to injection, injection pressure and other factors concerning the characteristics of the injection fluid.7 Del.
