Section 1352-B-10.0 - Relocation, Repairs and Modifications Requirements for ASTs10.1 General Requirements for Relocation, Repairs and Modifications 10.1.1 At any time excavation of soil or removal of concrete, asphalt, or other cover is required during the course of Relocation, Repairs and Modifications Owners and Operators shall perform soil sampling and analysis in accordance with those requirements identified in DERBCAP and Part E of this regulation, to measure for the presence of a Release where contamination is most likely to be present at the AST site. An Owner or Operator shall comply with the conditions specified in Part A, subsection 5.4 of this regulation to request an exemption of the Tier 0 investigation requirements.10.1.2 Within 90 days of completion of a Relocation, Repair or Modification, Owners and Operators shall submit documentation to the Department including the following: 10.1.2.1 AST Activity completion documentation; and10.1.2.2 Results of Tier 0 sampling requirements specified in DERBCAP; and10.1.2.3 Results of any tests required by the Department.10.1.3 Repairs, modifications and relocations shall be performed, inspected and tested in accordance with API 653 or STI-SP001 or STI-SP031 or NACE SP0294 or ASME RTP-1 Reinforced Thermoset Plastic Corrosion Resistant Equipment as applicable or other standards approved by the Department.10.2 Additional Requirements for Relocated ASTs 10.2.1 All relocated ASTs shall meet the standards for New ASTs as applicable, with the exception that the Department may approve the use of the existing material of construction, and shall meet the following requirements before the AST is utilized for storage of regulated substances:10.2.1.1 The Owner or Operator shall notify the Department of the scheduled relocation and shall have received a formal letter of approval according to the requirements of PART B, Section 1.0; and10.2.1.2 A thorough internal and external cleaning and inspection performed by a Certified API 653 Inspector or a Certified STI-SP001 Inspector or individual certified under ASME RTP-1 or National Board Inspection Code, as applicable, determines in its new location that the AST is free of defects per the requirements of the applicable code; and10.2.1.3 The AST is determined to be structurally sound in its new location by a Professional Engineer or an inspector certified per the applicable code such as a Certified API 653 Inspector or a Certified STI-SP001 Inspector, or qualified by training and experience in the absence of a code certification process.7 Del.
