Section 103-23.0 - Failure to appear at hearing23.1 A party's failure to appear at a hearing that has been duly noticed shall not be cause to continue the hearing. If the hearing officer so orders, the hearing shall proceed in the party's absence, which shall be noted in the record.23.2 The hearing officer, in his or her discretion, may choose to treat a respondent's failure to appear at the hearing as a default and issue an order pursuant to Rule 15.6.6 Del. Admin. Code § 103-23.0
