Section 3 CCR 721-1.5 - MANDATORY DISCLOSURE STATEMENT (C.R.S. sections 12-245-216, 12-245-224(1)(p))A. As used in section 12-245-216, C.R.S., and this Rule, 1. If the recipient of psychotherapy or mental health services is an adult for whom a guardian or legal representative has been appointed by a court of competent jurisdiction (irrespective of an appeal of the order) because the adult is an "incapacitated person" within the meaning of section 15-14-101(1), C.R.S., the mandatory disclosure is made to the guardian or legal representative.2.
