Section 3.12 - Presumption of Availability

Whenever there is a doubt, question or dispute about whether particular records are subject to disclosure as public records or exempt from disclosure, there shall be a presumption that the records in question are public records. This presumption may be overcome upon a specific showing by the person requesting confidentiality that the records in questionare trade secrets, or are otherwise exempt from disclosure.
