Section 164.039 - Nondiscrimination and Accommodation(A) No Licensed or Approved Provider shall discriminate in the provision of service against any person on the basis of race, color, ethnicity, religious creed, national origin, sex, sexual orientation, gender identity, age, disability, genetic information, ancestry or status as a veteran.(B) No Licensed or Approved Provider shall discriminate in the provision of service against any Medicaid recipient.(C) Program space, including satellites and medication units, used for patients or residents shall be accessible to individuals with disabilities and shall comply with all federal, state and local requirements for accessibility.Amended by Mass Register Issue 1305, eff. 1/29/2016.Amended by Mass Register Issue 1482, eff. 11/11/2022.
