Section 153.009 - Acceptance of Application(A) The Department shall not accept an application for an original or renewal license unless: (1) The application includes all information required by the Department;(2) The application, all required attachments and statements, and a Notice of Intent form, if applicable, submitted by the applicant meet the requirements of 105 CMR 153.000; and(3) The applicant has paid all required fees.(B) In the case of a transfer of ownership of a long term care facility: (1) an application for licensure shall not be accepted until the applicant has been deemed suitable subsequent to the submission of a Notice of Intent Form; and(2) the application of a new owner for a license shall not have the effect of a license unless the new owner has met the requirements for suitability review as outlined in M.G.L. c. 111, § 71, as well as the requirements of 105 CMR 153.009(A)(1) through (3).Amended by Mass Register Issue 1303, eff. 1/1/2016.Amended by Mass Register Issue 1372, eff. 8/24/2018.
