Section 333.10 - Authority(a) The priorities and allocations authorities of the President under Title I of the Act that have been delegated to the Secretary of Homeland Security have been redelegated to the Administrator. These rules are issued pursuant to Title I of the Act, and implementing authorities, including such authorities as are contained in subchapter III of chapter 55 of title 50, United States Code (50 U.S.C. 4554 , 4555 , 4556 , and 4560 ), which have been delegated to FEMA.(b)Delegations by FEMA. FEMA may authorize Delegate Agencies to assign priority ratings to orders under these regulations as authorized.(c)Jurisdictional limitations. Unless delegated by the President to DHS or FEMA, the provisions of this part are not applicable to the following resource categories, as defined in Executive Order 13603, a successor executive order, or implementing regulations issued thereunder: (1) Food resources, food resource facilities, and the domestic distribution of farm equipment and commercial fertilizer (Resource department with jurisdiction-Department of Agriculture);(2) Energy supplies (Resources agency with jurisdiction-Department of Energy);(3) All forms of civil transportation (Resource department with jurisdiction-Department of Transportation);(4) Health resources (Resource department with jurisdiction-Department of Health and Human Services), except that pursuant to Executive Order 13911, the provisions of this part are applicable to health and medical resources needed to respond to the spread of COVID-19;(5) Water resources (Resource department with jurisdiction-Department of Defense); and(6) All other materials, services, and facilities, including construction materials ("industrial resources") (Resource department with jurisdiction-Department of Commerce).
