Section 261.140 - Applicability(a) The requirements of this subpart apply to owners or operators of reclamation and intermediate facilities managing hazardous secondary materials excluded under 40 CFR § 261.4(a)(24) , except as provided otherwise in this section.(b) States and the Federal government are exempt from the financial assurance requirements of this subpart.
