Section 52.1488 - Visibility protection(a) The requirements of section 169A of the Clean Air Act are not met, because the plan does not include approvable procedures for protection of visibility in mandatory Class I Federal areas.(b) Regulation for visibility monitoring and new source review. The provisions of § 52.28 are hereby incorporated and made a part of the applicable plan for the State of Nevada except for that portion applicable to the Clark County Department of Air Quality and Environmental Management.(e)Approval. On November 18, 2009, the Nevada Division of Environmental Protection submitted the "Nevada Regional Haze State Implementation Plan." With the exception of the BART determination for NOX at Reid Gardner Generating Station in sections 5.5.3 , 5.6.3 and 7.2 ; the NOX averaging time and control type for units 1, 2 and 3 in sub-paragraph (1)(c) of Nevada Administrative Code section 445B.22096; and the NOX emission limit for unit 3 in sub-paragraph (1)(c) of Nevada Administrative Code section 445B.22096; the Nevada Regional Haze State Implementation Plan, as supplemented and amended on February 18, 2010 and September 20, 2011, meets the applicable requirements of Clean Air Act sections 169A and 169B and the Regional Haze Rule in 40 CFR 51.308 .(g)Approval. On November 18, 2014, the Nevada Division of Environmental Protection submitted the "Nevada Regional Haze Plan 5-Year Progress Report" ("Progress Report").
