Section 1005.829 - Certificate of property condition(a) As part of the claim submission, the Servicer shall either: (1) Certify that as of the date of the deed or assignment of the loan to HUD the property was: (i) Undamaged by fire, flood, earthquake, or tornado;(ii) Undamaged due to failure of the Servicer to act as required by § 1005.767 ; and,(iii) Undamaged while the property was in the possession of the Borrower; or,(2) Include a copy of HUD's authorization to convey the property in damaged condition.(b) In the absence of evidence to the contrary, the Servicer's certificate or description of the damage shall be accepted by HUD as establishing the condition of the property, as of the date of the deed or assignment of the Section 184 Guaranteed Loan.
