Disqualified means that a person is prohibited from participating in specified Federal procurement or nonprocurement transactions as required under a statute, Executive order (other than Executive Orders 12549 and 12689), or other authority. Examples of disqualifications include persons prohibited under-
(a) The Davis-Bacon Act (40 U.S.C. 3142 );(b) The equal employment opportunity acts and Executive orders; or(c) The Clean Air Act (42 U.S.C. 7606 ), Clean Water Act (33 U.S.C. 1368 ), and E.O. 11738 (38 FR 25161, 3 CFR, 1973 Comp., p. 799);(d) 515(h) of the Federal Crop Insurance Act (7 U.S.C. 1515(h) );(e) Section 12 of the Food and Nutrition Act of 2008 (7 U.S.C. 2021 ). 84 FR 52996, 10/4/2019; 89 FR 68326, 10/1/2024
