(a) Relocation of a program outside of the county indicated on its license shall be prohibited except as authorized in this section.(b) To relocate a program outside of the county indicated on the license, the licensee shall submit to the Department an Initial Application Coversheet form DHCS 5014 (04/16) and a written protocol as described in Section 10030(a) at least 120 days prior to the proposed relocation date.(c) The Department may issue a new license to a program requesting relocation pursuant to subsection (b) if that program is determined by the Department to have submitted a satisfactory protocol, be able to conform to all applicable statutory requirements and regulations, and have demonstrated need and received a recommendation from the County Alcohol and Drug Program Administrator.(d) The Department shall notify the licensee, in writing, within 60 days of receipt of the application whether the application is: (1) Complete, including all required documents specified in Section 10030, and accepted for review; or(2) Incomplete, and the Department shall specify the missing or incomplete information or documentation. The licensee shall have 60 days from the date of the notification to provide the missing information or documentation. The Department shall terminate review of the relocation request if the licensee does not provide all required information or documentation within 60 days. Upon termination of review, the incomplete relocation request shall be returned to the licensee. The licensee may reapply by submitting a new relocation request to the Department. Termination of review shall not constitute a licensing action.(e) The Department shall either approve or deny, in writing, a complete relocation request within 60 days after the request is accepted for review.Cal.
