When the tally of ballots discloses that the challenged ballots are sufficient in number to affect the outcome of the election, unless otherwise provided by a consent election agreement, SMCS shall conduct an investigation and, where appropriate, conduct a hearing or take such other action as deemed necessary to determine the eligibility of the challenged voters. Any determination made by a hearing officer pursuant to this section may be appealed to the Board itself in accordance with the provisions of Chapter 1, Subchapter 4 of these regulations.
