Section 12012 - Nominations, Elections, and Assumption of Office of Eligible Parent Members(a) No later than March 1 of even number years, operating agencies represented on the RPAC shall convene Parent Advisory Council (PAC) meetings for the purpose of nominating eligible parents to the RPAC. These meeting dates shall ensure timely election of the RPAC to align with elections for the State Parent Advisory Council (SPAC) as specified in the California Code of Regulations, title 5, section 12033.(b) Eligible parents shall nominate eligible parents as candidate(s) for election to membership on the RPAC. Candidates need not be officers of PACs in order to be nominated. Such nominations shall occur as follows:(1) At the time of their nomination, only eligible parents from an operating agency or DFD within the service area of the Migrant Region are eligible to nominate and be nominated as a parent member of the RPAC.(2) At the nominating meeting, a presiding officer of the PAC shall invite eligible parents to orally nominate eligible parents for membership on the RPAC.(3) A nominating parent may only nominate one person as a parent member.(4) Only an eligible parent present at the PAC nominating meeting may be nominated.(5) The PAC president or a PAC officer shall ask the nominee whether he or she accepts the nomination.(6) The operating agency or DFD migrant program administrator or designee shall record the name of the nominee.(7) The person nominated shall orally answer in the affirmative if he or she accepts the nomination.(8) The operating agency or DFD migrant program administrator or designee shall record the name of the nominee(s) who accept(s) the nomination.(9) Immediately after receiving and recording nominations and acceptances, the operating agency or DFD migrant program administrator or designee shall read aloud the names of the persons who were nominated and accepted the nomination. The operating agency or DFD migrant program administrator or designee shall then provide eligible parents with the opportunity to make corrections to the list of nominees.(10) The MEP administrator from the operating agency or DFD whose PAC is holding the election shall verify the eligibility of the parents nominating a candidate for membership on the RPAC, as well as the eligibility of the nominees, by March 15. Ineligible candidates will also be notified by March 15.(c) After the nominating meeting, elections of parent members to the RPAC shall take place between April 1 and April 15 of even number years, as follows: (1) Only eligible parents who are enrolled in schools within the service area of that Migrant Region may vote to elect parent candidates.(2) Only parents nominated pursuant to subdivision (b) may be elected to the RPAC.(3) Elections pursuant to this section shall occur at a single meeting.(4) Voting shall be by secret ballot.(5) Each eligible parent shall cast a single vote for the nominee of choice.(6) Votes shall be counted and tallied by the MEP administrator or designee along with two additional PAC members at the same meeting in which the election is held.(7) The nominee receiving the most votes, whether a majority or a plurality, shall be elected to the RPAC.(8) The elected parent shall immediately assume membership on the RPAC upon election.(9) Upon election of a new eligible parent member to the RPAC, membership of previous member(s) not elected to the RPAC shall immediately terminate.Cal.
