Cal. Code Regs. tit. 23 § 3919.15
On June 11, 2014, the San Francisco Bay Regional Water Quality Control Board (Water Board) adopted Resolution No. R2-2014-0027, amending the Water quality Control Plan for the San Francisco Bay Region. This amendment establishes a total maximum daily load (TMDL) for sediment in Lagunitas Creek, and an implementation plan to achieve the TMDL and related habitat enhancement goals.
The objective of this amendment is to reduce fine sediment (primarily sand) deposition in Lagunitas Creek and its tributaries, as needed to support recovery of coho salmon and steelhead runs. The amendment also is expected to enhance channel habitat complexity and connectivity to the floodplain. The TMDL allocates discharges of sediment to natural erosion processes, non-point sources generated by human actions (e.g., roads, grazing, and accelerated bed and bank erosion along Lagunitas creek and the alluvial reaches of its tributaries), and minor point sources including construction activities and stormwater runoff.
The amendment establishes:
* A sediment TMDL [LESS THAN EQUAL TO] 120 percent of the natural background sediment load;
* Numeric targets for sediment, as indicated by streambed mobility and red scour;
* Numeric targets for habitat condition, as indicated by the amount of large woody debris in channels;
* Allocations for all significant sediment sources;
* An implementation plan to achieve the TMDL and related habitat enhancement goals; and
* A plan and schedule to evaluate and monitor progress towards meeting targets.
To implement the required control measures, the Water Board will rely on Waste Discharge Requirements (WDRs), Waivers of WDRs, Clean Water Act Section 401 permits, and existing NPDES permits for urban stormwater runoff and/or construction activities.
Approximately every five years, the Water Board will evaluate monitoring results and assess progress made towards attaining targets and load allocations. New and relevant information and monitoring, special studies and scientific literature will be taken into account as it becomes available. The Water Board may revise the TMDL and implementation plan and schedule as necessary through tis adaptive implementation process.
