In addition to Sections 80070 and 84070, the following shall apply:
(a) The licensee shall ensure that the following are included in the child's record: (1) A copy of the child's individual health care plan, including associated nursing care plans.(2) Medical records including immunizations, consultations, and diagnostic screenings.(3) Documentation that the child has a developmental disability and is receiving services and case management from a regional center.(4) If applicable, documentation that the child has been adjudged a dependent of the court under Section 300, 600 or 602 of the Welfare and Institutions Code, or has not been adjudged a dependent of the court pursuant to Section 300 of the Welfare and Institutions Code but is in the custody of the county welfare department.(5) Record of medications and treatments administered, including initials of staff administering the medication or treatment.(A) The record of medications shall also include any medication errors and adverse drug reactions, including minor adverse reactions identified in the literature accompanying the product as a usual or common side-effect.(6) If applicable, the child's written hospice care plan, pursuant to Section 84775.1(a)(4) and (b), and the records required to be maintained for each child receiving hospice services specified in Section 84775.1(h)(1) through (4).Cal. 1. New section filed 4-27-2023 as an emergency; operative 4/27/2023 (Register 2023, No. 17). A Certificate of Compliance must be transmitted to OAL by 10-24-2023 or emergency language will be repealed by operation of law on the following day.
2. New section refiled 10-17-2023 as an emergency, including amendment of subsections (a)(1)-(3); operative 10/24/2023 pursuant to Government Code section 11346.1(d) (Register 2023, No. 42). Pursuant to Health and Safety Code section 1567.51(c)(2)(B), this regulatory action and its first readoption are deemed to be an emergency and are exempt from review by OAL and remain in effect for 180 days. A Certificate of Compliance must be transmitted to OAL by 4-22-2024 or emergency language will be repealed by operation of law on the following day.
