Section 84764 - Administrator Qualifications and Duties

In addition to Sections 80064 and 84064, with the exception of Section 84064(e), the following shall apply:

(a) An administrator of a Group Home for Children with Special Health Care Needs must be on duty at least 20 hours per week to ensure the effective operation of the facility.
(b) An administrator of a Group Home for Children with Special Health Care Needs shall meet the Administrator Certification Requirements of Section 84064.2, have at least one year of administrative and supervisory experience with a licensed residential program for persons with developmental disabilities and be one or more of the following:
(1) A licensed registered nurse.
(2) A licensed nursing home administrator at the time of facility licensure.
(3) A licensed psychiatric technician with at least five years of experience serving individuals with developmental disabilities.
(4) An individual with a bachelor's degree or more advanced degree in the health or human services field and two years of experience working in a licensed residential program for persons with developmental disabilities and special health care needs.

1. New section filed 4-27-2023 as an emergency; operative 4/27/2023 (Register 2023, No. 17). A Certificate of Compliance must be transmitted to OAL by 10-24-2023 or emergency language will be repealed by operation of law on the following day.
2. New section refiled 10-17-2023 as an emergency; operative 10/24/2023 pursuant to Government Code section 11346.1(d) (Register 2023, No. 42). Pursuant to Health and Safety Code section 1567.51(c)(2)(B), this regulatory action and its first readoption are deemed to be an emergency and are exempt from review by OAL and remain in effect for 180 days. A Certificate of Compliance must be transmitted to OAL by 4-22-2024 or emergency language will be repealed by operation of law on the following day.
3. Certificate of Compliance as to 10-27-2023 order transmitted to OAL 11-30-2023 and filed 1/11/2024 (Register 2024, No. 2).
