Section 9211 - Panel's Determination of Appeal
(a) Within sixty days after the filing of an appeal under Article 2 of this Chapter, the chairperson of the Panel shall call a meeting of the Panel to consider and act on the appeal.
(b) If the Panel finds that the project is necessary for the preservation of the public peace, health, or safety within the meaning of Article IV of the California Constitution, the Panel may in its discretion:
(1) waive the permit;
(2) amend any condition established by the permit; or
(3) issue a permit that has been denied by the permitting agency. The Panel shall mail written notice of its decision to the Department or local agency and the permitting agency.
