Section 164 - Criteria for Rehabilitation

When considering eligibility for the Program, or reinstatement of certification of an individual who was disciplined as a result of an act as set forth in section 161, the State Architect or designee may consider the following criteria:

(a) Nature and severity of the act(s) or offense(s).
(b) The time that has elapsed since commission of the act(s) or offense(s).
(c) If applicable, evidence of expungement proceedings pursuant to sections 1203.4, 1203.4a, or 1203.41 of the Penal Code.
(d) Demonstration of meeting the conditions for reinstatement as determined upon the conclusion of the investigation of a violation that results in suspension of certification or denial of certification renewal.
