Section 9.6 - (Rule 9.6) Circumstances Not Constituting Cause

It shall not be cause for disqualification that the Commissioner or Administrative Law Judge:

(a) Is or is not a member of a racial, ethnic, religious, sexual or similar group and the proceeding involves the rights of such a group.
(b) Has past work experience, technical competence, or specialized knowledge of or has in any capacity expressed a view on a legal, factual or policy issue presented in the proceeding, except as provided in Rule 9.3.
(c) Has, as a representative or public official participated in the drafting of laws or regulations or in the effort to pass or defeat laws or regulations, the meaning, effect, or application of which is in issue in the proceeding unless the Commissioner or Administrative Law Judge believes that the prior involvement was such as to prevent the Commissioner or Administrative Law Judge from exercising unbiased and impartial judgment in the proceeding.
