Section 327 - Cancellation or Withdrawal of Notice of Rejection

The appointing power may cancel or withdraw a notice of rejection during probation by filing with the Board a written notice of cancellation or withdrawal setting forth the reasons therefore. The written notice of cancellation or withdrawal shall be filed with the Board no later than 45 days after the effective date of the rejection on probation.

An employee whose probationary rejection is canceled or withdrawn shall be entitled to payment of salary less legal offsets, if any, and credit for seniority, sick leave, vacation, and merit salary adjustment that he or she would have otherwise received but for the initial rejection on probation.

A cancellation or withdrawal of rejection shall be without prejudice to further rejection, punitive action, or disciplinary proceedings for the same or other reasons.
