Section 2626 - Scrap-Only Program(a) Each vehicle must pass the visual and operational inspection required by the Consumer Assistance Program, performed by the dismantler or BAR representative, and conducted on-site at the dismantler location. The inspection requirements for the Consumer Assistance Program are defined in sections of title 163394.4(b)(7) and 3394.4(b)(8) of title 16 of Division 33, Article 11 of the California Code of Regulations. Vehicles failing the inspection requirements may be re-inspected by the dismantler or BAR representative for compliance with these requirements at any time after modifications have been made to the vehicle to correct any deficiencies.(b) In order to participate in the EFMP Scrap-only program, an individual must have household income less than or equal to 225% of FPL.(c) An applicant determined to be eligible under the Scrap-only program of the EFMP shall voluntarily sell the vehicle to the dismantler and shall receive payment of no less than $1,500.00 for each vehicle scrapped from operation at a dismantler operating under contract with the Bureau.(d) Once the dismantler has purchased the vehicle, the participant's eligibility status or the amount paid to the participant cannot change.(e) Model year 1976 and newer vehicles must have successfully completed a Smog Check inspection (pass or fail) within 180 days of the date of application to the EFMP. A Smog Check inspection does not include aborted, manual mode, or training mode tests. Vehicles exempt from the Smog Check program as defined in title 16 of the California Code of Regulations section 3340.5 do not require a Smog Check inspection to qualify for the EFMP.(f) An applicant may scrap only one vehicle through the EFMP or the BAR Consumer Assistance Program within a 12-month period; except a vehicle owner who is a joint owner of the vehicle being scrapped may scrap up to two vehicles through the EFMP or BAR Consumer Assistance Program within a 12-month period.Cal.
