Section 2614.6 - Burden and Order of Proof(a) The Department or intervenor has the burden of proving, by a preponderance of the evidence, every fact necessary to show in what manner and to what extent noncompliance is alleged to exist.(b) In addition to its burden of proof, the Department or intervenor shall have the burden of presenting its evidence and witnesses first.Cal.
