Section 2614.2 - Commencement of Proceedings(a) An enforcement action is commenced when the Department serves a written notice of noncompliance pursuant to California Insurance Code section 1858.1, which shall state in what manner and to what extent non-compliance is alleged to exist; specifying a reasonable time, not less than 10 days thereafter, in which that noncompliance may be corrected; and specifying the amount of any penalty that may be due under Insurance Code section 1858.07.(b) An administrative proceeding is commenced when the Department files a request for hearing pursuant to California Insurance Code section 1858.2 with the Administrative Hearing Bureau. The request for hearing shall include copies of any notice of noncompliance served on respondent by the Department and any written response thereto by respondent.Cal. Code Regs. Tit. 10, § 2614.2
