Section 5.5103 - Amendment of Accusation(a) The Commissioner may amend an accusation at any time before or during an adjudicatory hearing. An amendment of an accusation shall be in writing and signed by the Commissioner.(b) Any amendment of an accusation shall be deemed to be denied by the respondent.(c) Whenever the Commissioner amends an accusation, he shall promptly serve a copy of the amendment on the respondent and each other party.(d) Whenever an amendment of an accusation presents new charges, the Commissioner or the hearing officer shall, upon application of the respondent, continue an adjudicatory hearing for such time as may be necessary to afford the respondent a reasonable opportunity to prepare his defense to such new charges.Cal.
