Section R6-12-1001 - Entitlement to a HearingA. An applicant for or recipient of CA is entitled to a hearing to contest the following Department actions: 1. Denial of the right to apply for assistance;2. Complete or partial denial of an application for assistance or for supplemental benefits;3. Failure to make an eligibility determination on an application within 45 days of the application date;4. Suspension, termination, reduction, or withholding of benefits except as provided in subsection (B).5. The existence or amount of an overpayment attributed to the unit or the terms of a plan to repay the overpayment;6. Changing the manner or form of payment including naming a protective payee to receive the benefit payment; or7. Denial or termination of child care benefits. B. Applicants and recipients are not entitled to a hearing to challenge benefit adjustments made automatically as a result of changes in federal or state law, unless the Department has incorrectly applied such law to the individual seeking the hearing.Ariz.
