Section R3-3-504 - MitigationA. A violation listed in R3-3-501 is a nonserious violation if: 1. The violator did not, and could not with the exercise of reasonable diligence, know of the safety or human health risk involved; or2. The release is done to avoid an accident that would have resulted in greater harm than that caused by the pesticide release or is caused by mechanical malfunction beyond the control of the operator.B. A violation listed in R3-3-502 is a de minimis violation if: 1. The violator did not, and could not with the exercise of reasonable diligence, know of the safety, health, or property damage risk involved; or2. The release is done to avoid an accident that would have resulted in greater harm than that caused by the pesticide release or is caused by mechanical malfunction beyond the control of the operator.Ariz.
